Terms of Service

TestSwap ("we", "us", "our") is a peer-to-peer matching platform that connects UK driving test candidates who wish to exchange their DVSA practical or theory test booking dates with other candidates. TestSwap does not hold, modify, or transfer any DVSA bookings directly.

By registering an account or using any part of our platform, you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform.

To use TestSwap as a learner you must:

• Be at least 17 years of age
• Hold a valid, active DVSA driving test booking in the United Kingdom
• Provide accurate and truthful information during registration
• Have a valid email address and, where requested, a valid UK phone number

To use TestSwap as an instructor you must additionally hold a valid DVSA Approved Driving Instructor (ADI) licence and provide your ADI licence number during registration for verification.

Each registered learner account is limited to a maximum of two (2) completed test date swaps in total. This limit is permanent and non-transferable. Once two swaps have been completed on an account, no further swap requests may be submitted.

This limit exists to maintain fairness across the platform and to prevent misuse. The limit cannot be increased and may only be overridden by TestSwap administrators in exceptional circumstances, at our sole discretion.

The TestSwap platform operates as follows:

• You submit your current DVSA test booking details and your preferred date range
• Our matching engine identifies another user whose booking and preferences are mutually compatible
• Both parties are notified and must independently confirm they agree to the swap within 24 hours
• Once both parties agree, each party receives the other's DVSA booking reference and step-by-step instructions
• Each party must independently call DVSA on 0300 200 1122 using the provided reference to complete the transfer. TestSwap does not make this call on your behalf

TestSwap provides the matching infrastructure and facilitates the secure exchange of booking references only. We make no guarantee that the DVSA call will result in a successful transfer, as this is determined solely by DVSA.

Learner swaps: Swapping your driving test date via TestSwap is free. There are no fees for registering, matching, or completing a swap.

Instructor subscriptions: Instructors pay a recurring monthly subscription fee based on their chosen plan. Subscription fees are billed monthly in advance. Plans are Starter (£4/month, up to 5 students), Pro (£12/month, up to 15 students), Agency (£20/month, up to 40 students), and Enterprise (£30/month, unlimited students). Prices are subject to change with 30 days' notice.

Learner swaps are free. There are no swap fees to refund.

Instructor subscription fees are non-refundable mid-cycle. If you cancel your subscription, access continues until the end of the current billing period.

In the event of a technical error resulting in a duplicate charge, a full cash refund will be processed within 24 hours.

By using TestSwap you agree that:

• You will only submit genuine DVSA test bookings that you personally hold
• You will not attempt to deceive, defraud, or manipulate other users
• You will not create multiple accounts to circumvent the 2-swap limit
• You will personally call DVSA on 0300 200 1122 to complete any swap once booking references are released
• You understand that TestSwap cannot guarantee a match will be found for your swap request
• You understand that TestSwap cannot guarantee that a DVSA call will result in a successful transfer
• You will not attempt to contact the other matched party by any means other than through the DVSA process

Instructors who register on TestSwap agree to the following additional terms:

• You must provide a valid ADI licence number and consent to verification
• Your subscription grants you access to instructor dashboard features for the duration of your active subscription
• Students must independently confirm the link to your account before you may act on their behalf
• You may not override a student's agreement or payment decision
• Monthly swap submissions count towards your plan limit regardless of outcome
• Unused monthly swap allowances do not roll over to the following month
• You are responsible for ensuring you have appropriate permissions from students before submitting swap requests on their behalf

The following are strictly prohibited and may result in immediate account suspension:

• Submitting false, fabricated, or expired DVSA booking references
• Creating accounts under false identities
• Attempting to access another user's account or data
• Using automated tools, bots, or scripts to interact with the platform
• Commercially reselling access to the platform or sharing account credentials
• Harassing, threatening, or abusing other users or TestSwap staff

TestSwap is provided "as is". We make no warranties — express or implied — that the platform will be uninterrupted, error-free, or that every swap request will result in a match.

TestSwap is not responsible for:

• Any failure by DVSA to complete a test date transfer following a user's call
• Any loss arising from a match being dissolved due to another party's failure to agree or pay
• Any test date or opportunity lost as a result of using the platform
• The accuracy of DVSA test centre or availability information

To the maximum extent permitted by UK law, our total liability to any user for any claim arising from use of the platform is limited to the total fees paid by that user in the 12 months preceding the claim.

We reserve the right to suspend or permanently terminate any account that violates these Terms of Service, engages in fraud, or misuses the platform, without prior notice and without refund.

You may request deletion of your account at any time via your account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy, subject to our legal retention obligations.

We may update these Terms of Service from time to time. Where changes are material, we will notify you by email at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the revised terms.

These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
